Justice For All Party Wins Certification


A federal judge has ordered the North Carolina State Board of Elections to certify the Justice for All (JFA) Party and include its candidates on the state's November ballot, giving voters the option to select left-of-center activist and academic Cornel West for president. The Board had previously denied JFA's ballot access in a 3-2 party-line vote, with Democrats opposing and Republicans supporting the certification.


U.S. District Judge Terrence Boyle ruled in favor of JFA, stating that the Board's decision likely violated the First Amendment by preventing the party and its candidates from participating in the election. Boyle issued an injunction to ensure that JFA candidates are included on the ballot, criticizing the Board's handling of petition signature verification as flawed.


While the judge sided with JFA on First Amendment grounds, he dismissed the plaintiffs' procedural due process claims. The ruling requires the Elections Board to certify the JFA Party and add qualified candidates to the upcoming election. The decision comes amid broader legal disputes involving various political parties' access to the North Carolina ballot.
